EU-Directive on package travel

More legal certainty in travel

The German insurance industry welcomes the revision of the Directive on package travel, package holidays and package tours. It supports the objectives to strengthen consumer protection and increase transparency and legal certainty for travellers and travel organisers.

Most of the new provisions of the Commission’s Proposal on liability and compensation for damages that are relevant for liability insurance are being supported by the German insurers. Nevertheless, German insurers have strong concerns regarding the proposed liability of the tour organiser in case of force majeure and suggest the withdrawal of this provision.

The extension of insolvency protection, which is relevant for surety insurance, is also basically welcomed. Some of the wording, however, should be amended for the purpose of clarification.
